BY VIRTUE OF A DECREE AND ORDER OF SALE OF THE UNITED STATES DISTRICT COURT – WESTERN DISTRICT OF KENTUCKY – BOWLING GREEN DIVISION, re: U. S. Securities & Exchange Commission v. David Craven Case - No. 1:15-mc-00003-GNS AND Anna Craven - Case No. 1:15-mc-00004-GNS, Joe B. Houchens Auctioneers, Inc.will sell at public auction the real property in the following action on Thursday, August 25th, 2016, at 5:00PM-CST on the site of the premises located in the 700 Block of Brawner Road – Alvaton, KY, 42122.

 

Said property shall be sold under the following terms and conditions: (A.) There will be a seven percent (7%) buyer's premium added to successful bid to determine sale price of real estate. (B.) The successful bidder shall tender to the Auctioneer either the full amount bid in cash or a down payment of ten percent (10%) of the successful bid. If the purchase price is not paid in full, the successful bidder shall execute a bond at the time of sale with sufficient surety to secure the unpaid balance of the purchase price. The bond shall bear interest at 12% per annum from the date of the sale until paid.  Closing shall take place on or before September 23rd, 2016.  (C.) The property is sold subject to the following: 1. State, county, city, and school taxes payable for the entire year of 2016 by the Purchaser.  2. Easements, restrictions, and covenants of record. 3. Assessments for public improvements levied against the property. 4. Any facts which an inspection or accurate survey of the property may disclose. (D.) The property shall otherwise be sold free and clear of any and all right, title, and interest of all parties to this action and of their liens and encumbrances thereon. (E.) Possession of the property shall be given with deed.  Purchaser will receive a Quit Claim Deed executed under the instruction of the United State District Court – Western District of Kentucky.  A title insurance commitment will be made available at closing with title exam and title insurance premium to be paid solely by the purchaser.  Time, place and closing attorney shall be at the sole discretion of Joe B. Houchens – Broker.  (F.) All property being sold “as is”.  Complete inspection of all property is encouraged prior to bidding.  All sales are final and are not contingent on purchaser being able to secure financing during the contract period.
