BY VIRTUE OF A DECREE AND ORDER OF SALE OF THE WARREN COUNTY COURT, the Master Commissioner will sell at public auction the real estate described in the following action on THURSDAY, APRIL 13TH, about the hour of 5:00 P.M., “ONSITE” at 1324 EDGEWOOD AVENUE, BOWLING GREEN, KY.  Said property shall be sold to collect the amounts hereinafter set forth, together with interest and the cost of the action, and upon the following terms and conditions (unless otherwise stated).

 

A. The purchaser will be required to pay (10%) down the day of sale and post bond on the remainder with the balance due in thirty (30) days. Said bond will bear interest at the rate of twelve percent (12%) per annum upon the unpaid balance from the date of sale until paid in full. The Master Commissioner will retain a lien on the property sold to secure the sale price. IF THE PURCHASER ELECTS TO POST BOND, HE/SHE WILL BE REQUIRED TO PROVIDE SUFFICIENT SURETY THEREON AT THE SALE. PLEASE CONTACT THE MASTER COMMISSIONER PRIOR TO THE SALE WITH ANY QUESTIONS REGARDING APPROVED SURETY AT 842-0614.  B. The property is being sold subject to the following: (a) State, county, city and school taxes payable for the entire year of 2017, and all taxes due hereafter. (b) Easements, restrictions and covenants of record. (c) Assessments for public improvements levied against the property. (d) Any facts which an inspection or accurate survey of the property may disclose. (e) Announcements made day of sale take precedence over all prior advertising. SERVICE ONE CREDIT UNION, INC. VS. TIM HUSTON; NANCY HUSTON; HANCOCK BANK & TRUST COMPANY; AMERICAN BANK & TRUST COMPANY; UNITED STATES OF AMERICA, DEPARTMENT OF TREASURY, INTERNAL REVENUE SERVICE; and COMMONWEALTH OF KENTUCKY, DEPARTMENT OF REVENUE, DIVISION OF COLLECTION pending in the WARREN CIRCUIT COURT DIVISION NO. II CIVIL ACTION NO. 17-CI-00082 to collect amount due and owing the Plaintiff, Service One Credit Union, Inc., as evidenced by the Adjustable Rate Note dated October 26, 2012, the Plaintiff is hereby awarded a personal Judgment against the Defendants, Tim Huston and wife, Nancy Huston, jointly and severally, in the amount of $470,573.84 together with interest accruing at the rate of 2.875 percent per annum from and after January 12, 2017, until entry of judgment, and with interest accruing at the rate of 12 percent per annum upon the judgment amount from entry until paid.

 

 

SALE – Property located at 1324 Edgewood Avenue, Bowling Green, KY (Warren PVA Parcel #040C-13-006), being the same property conveyed to Tim Huston and wife, Nancy Huston by deed dated December 20, 2005, of record in Deed Book 919, Page 4 in the Warren County Clerk’s Office.
