BY VIRTUE OF A DECREE AND ORDER OF SALE OF THE SIMPSON COUNTY COURT, the Master Commissioner will sell at public auction the real estate described in the following action on SATURDAY JUNE 3RD, 2017, at the hour of 10:00 A.M., “ONSITE” in the 700 BLOCK OF MILLIKEN CHAPEL ROAD, WOODBURN, KY.  Said property shall be sold to collect the amounts hereinafter set forth, together with interest and the cost of the action, and upon the following terms and conditions (unless otherwise stated).

 

A. The purchaser will be required to pay (10%) down the day of sale in the form of cash or personal check and post bond on the remainder with the balance due in thirty (30) days. Said bond will bear interest at the rate of twelve percent (12%) per annum upon the unpaid balance from the date of sale until paid in full.  If the purchaser elects to post bond, he/she will be required to provide sufficient surety.  ALL PROSPECTIVE PURCHASERS SHOULD PLAN ON HAVING THE PERSON OR ENTITY WHO WILL ACT AS SURETY TO BE IN ATTENDANCE AT THE SALE.  Please contact the Master Commissioner’s Office prior to the sale with questions regarding approved surety at 270-586-3283.  B. The property is being sold subject to the following: (a) State, county, city and school taxes payable for the entire year of 2017, and all taxes due hereafter. (b) Easements, restrictions and covenants of record. (c) Assessments for public improvements levied against the property. (d) Any facts which an inspection or accurate survey of the property may disclose.  (e) The property shall otherwise be sold free and clear of all right, title and interest of all parties to this action and of their liens and encumbrances thereon.  The Master Commissioner does not obtain a title search or investigate for further liens on the property(s) listed.  No survey of the property(s) is available.  The purchaser is responsible for obtaining a title search if desired.  (f) The subject property(s) is sold subject to a 120 day right or redemption pursuant to 28 U.S.C. SEC 2410, in favor of the Defendant United State of America, Internal Revenue Service.

 

WM CAPITAL PARTNERS, LLC v. ANTHONY M. THORNTON, ET AL pending in the SIMPSON CIRCUIT COURT DIVISION I - CIVIL ACTION NO. 15-CI-00343.  Said property shall be sold for the purpose of collecting in rem judgments in favor of First Southern National Bank as follows: (1) $16,161.96 with interest from and after March 27, 2017 on the principal balance of $7,814.74 at the rate of 11.5% per annum; (2) $47,151.94 with no interest accruing; (3) $674,283.38 with interest from and after March 27,2017 on the principal balance of $471,425.26 at the rate of 11.5% per annum; (4) $46,083.92 with interest from and after March 27,2017 on the principal balance of $32,052.47 at the rate of 11.5% per annum; (5) $23,071.26 with no interest accruing;  (6) Attorney fees and Court costs to be awarded to First Southern National Bank.

 

SALE – 98± acres located in the 700 Block of Milliken Chapel Road – Woodburn, KY (Simpson County PVA Parcel #016-00-00-010.01) and being the same property conveyed to Anthony W. Thornton and wife, Elizabeth C. Thornton, by deed dated November 7th, 1997 of record in Deed Book 211, Page 184 in the Simpson County Clerk’s Office.
